1. Acceptance of These Terms

These Terms and Conditions (“Terms”) govern your use of the website located at www.craigbergmann.com (the “Site”), which is operated by Craig Bergmann Landscape Design, Inc. (“CBLD,” “we,” “us,” or “our”), as well as your participation in any text messaging program we make available. By accessing or using the Site, or by enrolling in our text messaging program, you agree to be bound by these Terms. If you do not agree, do not use the Site or enroll in the messaging program.

2. About CBLD

CBLD is a full-service landscape design, installation, garden care, and nursery firm based in Lake Forest, Illinois. The Site is provided for informational purposes and to facilitate communication with prospective and current clients.

3. Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit any other person’s use of the Site. You agree not to:

  • Attempt to gain unauthorized access to any portion of the Site, our systems, or our networks
  • Use any automated means to access or collect content from the Site without our prior written permission
  • Interfere with the operation, security, or integrity of the Site
  • Submit false, misleading, or unlawful information through any form on the Site

4. Intellectual Property

All content on the Site, including text, photographs, illustrations, graphics, logos, video, and design, is owned by or licensed to CBLD and is protected by United States and international copyright, trademark, and other intellectual property laws. You may view and print pages from the Site for your personal, non-commercial use, but you may not otherwise copy, reproduce, distribute, modify, publicly display, or create derivative works from any content on the Site without our prior written consent.

5. Project Galleries and Photography

Photographs and project descriptions on the Site are provided for illustrative purposes. Plant material, hardscape, weather, site conditions, and time of year affect the appearance of any landscape, and individual results will vary. Inclusion of a project on the Site does not constitute an endorsement, recommendation, or guarantee of any specific outcome.

6. Third-Party Links

The Site may contain links to third-party websites, including our retail brand HORTUS and our social media profiles. These links are provided for convenience only. We do not control, and are not responsible for, the content, privacy practices, or operation of any third-party site. Your use of any third-party site is subject to that site’s own terms and policies.

7. Internal SMS Program Terms

CBLD operates an internal text messaging program used solely by CBLD employees for transactional business purposes. The following terms govern that program.

7.1 Program Description

The CBLD internal SMS program delivers transactional, business-operations text messages to enrolled CBLD employees. Current uses include automated credit card receipt notifications generated through an authorized application programming interface. The program is not used to send marketing or promotional messages, and is not made available to clients, vendors, or members of the public.

7.2 Eligibility and Opt-In

The program is available only to active CBLD employees. Employees opt in to the program during onboarding by providing their mobile telephone number and affirmatively consenting to receive text messages from CBLD as part of their job duties. Consent is recorded by CBLD’s Human Resources function.

7.3 Message Frequency

Messages are transactional and are sent only as needed in connection with the relevant business event (for example, when a credit card transaction occurs). Frequency varies and depends on the underlying business activity.

7.4 Message and Data Rates

Standard message and data rates may apply to each text message sent or received in connection with the program, in accordance with the rate plan the employee has with their wireless carrier. CBLD is not responsible for these charges.

7.5 Opt-Out

Enrolled employees may opt out of the program at any time by replying STOP to any program message. After opting out, the employee will receive a one-time confirmation message and will not receive further program messages. Employees who opt out and later wish to re-enroll may do so by contacting CBLD Human Resources.

7.6 Help

For assistance with the program, employees may reply HELP to any program message, or contact CBLD using the information in Section 11.

7.7 Carriers and Delivery

Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to the effective transmission from the network operator and is not guaranteed.

7.8 Privacy

Information collected in connection with the program is handled as described in our Privacy Policy. Mobile information and SMS opt-in consent data are not shared with third parties or affiliates for marketing or promotional purposes. Mobile information may be shared only with service providers and subcontractors strictly as necessary to operate and support the program.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT, INFORMATION, AND MATERIALS PROVIDED ON OR THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CBLD DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CBLD DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CBLD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF THE SITE OR PARTICIPATION IN THE INTERNAL SMS PROGRAM, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF CBLD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THESE TERMS DO NOT GOVERN OR LIMIT THE RIGHTS AND OBLIGATIONS OF CBLD AND ITS CLIENTS UNDER ANY SEPARATE WRITTEN PROPOSAL, DESIGN AGREEMENT, OR INSTALLATION CONTRACT, WHICH WILL CONTROL WITH RESPECT TO THE SUBJECT MATTER OF THOSE AGREEMENTS.

10. Governing Law and Venue

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site or participation in the SMS program will be resolved exclusively in the state or federal courts located in Lake County, Illinois, and you consent to the personal jurisdiction of those courts.

12. Changes to These Terms

Material changes will be communicated through the Site or other appropriate means. Your continued use of the Site or participation in the internal SMS program after the Effective Date of updated Terms means you accept the updated Terms.
